Abstract:
The procedure of the elections of the President of Russian Federation regulate three legal acts mainly. There are first of all: the Constitution of Russian Federation, which was adopted in the national referendum on 12 December 1993 year, federal law with day 12 June 2002 year about the basic guarantees of electoral rights and right to participation in the referendum of the Russian citizens and finally federal law with day 10 January 2003 year about the elections of the President of Russian Federation. First of these legal acts characterizes the major principles of the elections of head of state, in scope of the limitations of the passive electoral right and the rules of assumption of authority by the President of Russia. And so, article 81 of the Constitution of Russian Federation defines that the President of Russia shall be chosen on sixyear- old term of office (the last changes of the Constitution) by Russian citizens on the basis of common, equal and direct electoral right in voting secret. Moreover a person who wants to become a head of state in Russia should be 35 years old in a day of election. A candidate ought to possess Russian citizenship and also to live permanently on the territory of Russian Federation at least 10 years. What more, the Russian Constitution introduces the prohibition of re-election a head of state, which fulfilled duties two term of office in a row. In turn the last legal provision which was contained in a article 81 Constituton clearly states that the proper way of president’s elections regulates a special federal law.
In Reality, how it was already mentioned, a proper election’s procedure of Russian President regulates the federal law about the elections of the President of Russian Federation. It is a quite extensive legal act consisting on 88 articles, which unusually casuistical way describes individual stages of elections. And so the president’s elections in Russia usually orders the higher chamber of parliament, called the Federation Council. In this process very important role also plays the Central Electoral Committee of Russian Federation, which belongs to an independent organs of public authority keeping watch of the legality of electoral procedure. By the way there is necessary to underline that the Russian legislator ensures a right of defining the date of president’s elections by the Federation Council. The last mentioned sentence creates a major constitutional rule. But in the case of idleness of the higher chamber of Russian parliament the federal law concerning the elections of the President of Russian Federation predicts a supplementary (emergency) competence of the Central Electoral Committee, which in a suitable moment takes over function of the Federation Council and it orders a date of president’s election finally. - Link do Księgarni ŁTN: Księgarnia
