Abstract:
The establishment of exact rules of elections and the protection of the right to vote is the essential part of democracy. The regularity of the elections has to be guaranteed without bias by the public authority, which has to protect the right to vote trough the agency of legal guarantees.
From the individual forms of legal guarantees this article deals with the judicial protection
of elections and the issue of the conception of so-called electoral justice. It focuses especially to the Slovak constitutional system, although the article contains a short comparison of the Visegrade group’s systems at its end. The strong electoral justice is typical especially for the Slovak constitutional system, which shows the wide role of the constitutional court in this area. There was an institute of so-called electoral contempt, created as a specific form of tangible protection of legality of elections in legal proceeding in the constitutional court.
At the other hand, in the other countries of V4 group, the general courts are the preferred judicial protection of election.
The article shows the notable differences in the concepts of electoral justices within the middle European area. To preserve the young democracy and prevent misuse, the Slovak constitutional system established precautions, which go beyond the proceedings in contemporary
